The Intellectual Property Corporation of Malaysia (MyIPO) is proud to present the 1st National MyIPO Intellectual Property (IP) Mooting Competition 2026, to be held at MyIPO in 2026. This inaugural event marks a significant milestone in advancing legal education by bringing together law students from public and private universities across Malaysia to sharpen their advocacy skills and engage with real-world intellectual property challenges.

Through this competition, MyIPO seeks to nurture the next generation of IP lawyers who are not only skilled in argument and analysis but also prepared to address emerging issues in copyright, trademarks, patents, and other related IP legislation, as well as the challenges brought about by technological advancements in the digital era. More than just a contest, it is a platform for collaboration, dialogue, and growth strengthening Malaysia’s role in the evolving global IP landscape.

This year marks the beginning of a journey that we hope will inspire students to embrace mooting as an essential part of their legal education. The 1st National MyIPO Intellectual Property Mooting Competition 2026 promises to be an unforgettable and transformative experience.

ABOUT MOOTING

MyIPO recognises mooting as a vital part of shaping tomorrow’s legal professionals. Mooting trains law students in research, analysis, problem-solving, persuasive writing, and oral advocacy skills essential for success in practice. It pushes participants to distil complex legal principles into clear, compelling arguments and to present them with confidence.

While many leading law schools worldwide embed mooting within their core curriculum, some institutions in Malaysia still treat it as an extracurricular activity. MyIPO believes this undervalues its true role as a rigorous training ground and risks leaving students unprepared for the demands of a globalised profession.

The National MyIPO Intellectual Property Mooting Competition seeks to change that. More than a contest, it is a national platform where students, academics, and practitioners come together to engage with pressing IP challenges in an age of rapid innovation. Through this initiative, MyIPO aims to inspire and prepare a new generation of lawyers practice-ready, forward-looking, and equipped to lead in the evolving world of intellectual property law.

  • Promoting the substance and significance of Malaysian intellectual property laws, including all legislation administered by MyIPO such as the Patents Act 1983, Copyright Act 1987, Trademarks Act 2019, Industrial Designs Act 1996, Layout-Designs of Integrated Circuits Act 2000 and Geographical Indications Act 2022
  • Encouraging participants to study and apply Malaysian IP laws together with relevant international treaties and conventions in resolving mooting problems.
  • Developing the next generation of IP legal practitioners and policymakers who are competent in handling contemporary and future challenges in intellectual property law and practice.
  • Providing a platform for law students, regulators, industry players, and innovators to exchange knowledge and perspectives on IP law, innovation, creativity, and technology.

THE MOOT PROBLEM OVERVIEW

Artificial Intelligence on Trial: Copyright, Trademarks, and Patents at the Crossroads

The ‘IP Moot Problem’ at the National MyIPO Intellectual Property (IP) Mooting Competition 2026 is designed to challenge law students to engage with complex legal and policy issues arising from Malaysia’s evolving intellectual property landscape in the age of Artificial Intelligence (AI). Participants are expected to understand the evolution of IP law as a body of domestic and international norms that governs the protection of creative works, distinctive signs, and inventive activity in an increasingly digital and automated environment.

Mooters will be presented with a detailed fact pattern that requires them to apply domestic legislation, especially the Copyright Act 1987 (Act 332), the Trademarks Act 2019, and the Patents Act 1983, and, where appropriate, other related IP laws. In parallel, they must interpret Malaysia’s rights and obligations under core international treaties such as the Berne Convention, Paris Convention, TRIPS Agreement, Madrid Protocol, and the Patent Cooperation Treaty (PCT).

In line with current global priorities, this year’s moot problem integrates the theme of AI and IP rights as a central legal and ethical consideration. Participants must consider challenges such as authorship and originality in AI-generated works, the registrability and protection of AI-created trademarks, the recognition of AI as an inventor, and the balance between innovation, public interest, and fair competition. These issues are not only central to international discourse, but also crucial to the successful implementation of Malaysia’s intellectual property policies, which envision a robust, future-ready, and innovation-driven national IP ecosystem.

The competition seeks to inspire a new generation of IP lawyers who are not only strong in their legal knowledge but also guided by ethics and a sense of responsibility to strengthen Malaysia’s intellectual property framework. It also serves a bigger purpose encouraging fresh ideas, research, and policy thinking that can support Malaysia’s national interests while keeping pace with global best practices.

In summary, the IP Moot Problem is intellectually rigorous and policy relevant. It encourages critical legal reasoning, constructive debate, and creative problem-solving in a simulated judicial and appellate setting, laying the groundwork for future professionals who will help shape a resilient and forward-looking intellectual property regime for Malaysia and beyond.
